Q1. To which Main Modification does your comment relate? - MM23

Q3a. Do you consider this Main Modification is Legally Compliant? - No

The land use allocation proposals relating to 'new commercial facilities' allocation set out in the concept statement relates to land outside the boundary of the Deans Slade Farm SDA. To that extent it is not procedurally or legally correct. The full details are set out in Q4c.

Q4a. Do you consider this Main Modification is Sound? - No

This representation relates to MM23 and the extent of the site and whether land use allocation proposals in the concept statement can apply to land outside the allocation of the Deans Slade Farm SDA. The comments are made without prejudice to the objection to the allocation of this site and its release from the Green Belt.

The SDA site allocation is defined in the Lichfield Inset Plan 1 of the Policies Map Book and illustrated in the OS base plan in proposed Appendix H on page H.1. As defined the site does not include land being 'allocated' for 'new commercial facilities'. The site is located between the A5127 Birmingham Road and the Cross-City railway line to the south of the junction of the proposed Southern Bypass. The site Concept Statement in proposed Appendix H: South of Lichfield: Deans Slade Farm SDA does however in Map H.2 Concept Diagram include the area of land. It also has text which includes reference to that that land in the following terms:-

Paragraph H.3. item 8. New Commercial facilities will be provided alongside the Birmingham Road and junction to the proposed southern bypass. These facilities will be accessible to existing residents of the City and residents of further development proposed to the south of Lichfield City."

Since the land referred to as allocated for "New Commercial facilities" is currently in the Green Belt and outside the SDA boundary the SDA Concept Rationale cannot have any relevance to a site outside the allocation. The Concept Diagram and the text should be corrected to omit any reference to land outside the SDA allocation.

Q4d. If you consider the Main Modifications unsound, please set out what change(s) you consider necessary to make it sound and give your reasons.

The reasons for the changes detailed below are given in Q4c.

Correct the boundary line in the proposed Appendix H Map H.2 South of Lichfield Deans Slade Concept Diagram to exclude land outside the boundary of the Deans Slade Farm SDA allocation and delete the key about Commercial Facilities.

Delete the following text:-

Paragraph H.3: item 8. "New Commercial facilities will be provided alongside the Birmingham Road and junction to the proposed southern bypass. These facilities will be accessible to existing residents of the City and residents of further development proposed to the south of Lichfield City."
